1. Agreement to Terms
These Terms of Service ("Terms") govern your access to and use of the Seloops website, web application, and related services (collectively, the "Service") operated by Seloops, a company based in Kenya ("Seloops," "we," "us," or "our").
By creating an account, accessing, or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.
2. Description of Service
Seloops is a sales automation platform that enables teams to manage contacts, build email sequences, track pipeline activity, receive inbound replies, and use AI-assisted writing tools. Features may change over time as we improve the product.
3. Eligibility and Accounts
You must be at least 18 years old and have the authority to enter into these Terms on behalf of yourself or your organization. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
You agree to provide accurate registration information and to keep it up to date. Notify us immediately at johnson@seloops.com if you suspect unauthorized access to your account.
4. Acceptable Use
You agree not to use the Service to:
- Send spam, unsolicited bulk email, or messages that violate applicable anti-spam laws
- Harass, defraud, or mislead recipients
- Upload or transmit malware, illegal content, or content that infringes third-party rights
- Scrape, reverse engineer, or attempt to gain unauthorized access to the Service
- Interfere with or disrupt the integrity or performance of the Service
- Use the Service in violation of any applicable law or regulation
You are solely responsible for ensuring that your use of Seloops to contact prospects and customers complies with applicable laws, including consent and opt-out requirements in Kenya and in the jurisdictions where your recipients are located.
5. Subscriptions and Payment
Certain features require a paid subscription. Pricing, billing cycles, and plan limits are described on our website and may change with notice. By subscribing, you authorize us and our payment processors to charge applicable fees.
Free trials, where offered, convert to paid subscriptions unless cancelled before the trial ends. Fees are generally non-refundable except where required by law or explicitly stated otherwise. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period unless otherwise specified.
6. Your Content and Data
You retain ownership of contacts, emails, and other content you upload or create in the Service ("Customer Data"). You grant Seloops a limited license to host, process, and transmit Customer Data solely to provide and improve the Service.
You represent that you have the necessary rights and permissions to upload Customer Data and to use Seloops to communicate with your contacts. You are responsible for obtaining appropriate consent from recipients where required.
7. Intellectual Property
Seloops and its licensors own all rights in the Service, including software, design, trademarks, and documentation. These Terms do not grant you any ownership rights in the Service. You may not copy, modify, distribute, or create derivative works of the Service except as expressly permitted.
8. Privacy
Our collection and use of personal information is described in our Privacy Policy. By using the Service, you acknowledge that we will process data as described there.
9. Third-Party Services
The Service may integrate with or link to third-party services (such as email providers or payment processors). Your use of third-party services is governed by their terms and policies. Seloops is not responsible for third-party services.
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
Seloops is a tool to assist sales teams; we do not guarantee specific business results, reply rates, or revenue outcomes.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SELOOPS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO SELOOPS IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED US DOLLARS (USD $100), WHICHEVER IS GREATER.
12. Indemnification
You agree to indemnify and hold harmless Seloops from claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your Customer Data, or your violation of these Terms or applicable law.
13. Termination
You may stop using the Service and cancel your account at any time. We may suspend or terminate your access if you violate these Terms, fail to pay applicable fees, or if we reasonably believe your use poses a security or legal risk.
Upon termination, your right to use the Service ceases. Provisions that by their nature should survive termination (including ownership, disclaimers, limitation of liability, and indemnification) will survive.
14. Governing Law
These Terms are governed by the laws of the Republic of Kenya, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Kenya, unless otherwise required by applicable law.
15. Changes to Terms
We may modify these Terms at any time. We will post updated Terms on this page and update the "Last updated" date. Material changes may be communicated via email or in-app notice. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
